Terms of service

In short. We provide the software and keep it running and secure. You remain the deed writer: you check what it reads, you are responsible for the deeds you draw and for your clients' papers, and you keep your sign-in to yourself. You pay for what you use; either of us can end it; your records are yours to take away.
1. Who this is between
These terms are between Arvind Tyagi, proprietor, trading as Tyagi Tech Consulting ("we"), and the firm or person who subscribes to Bharatlekh ("you", "the office"). Using the service means accepting them. Bharatlekh is a private service and has no connection with any government department, authority or portal.
2. What the service is
Bharatlekh is software, used through a web browser, for keeping a deed writer's clients, properties and transactions, reading identity and property documents, working out costs and drawing documents. It is a tool for a professional. It does not give legal advice, does not register anything, and is not a substitute for your own judgement.
3. What you must check
- Anything read from a picture. A reading that goes wrong does not look wrong: it gives a plausible name, date or area. The service marks every value that was read and not proved, and you must check each against the document before relying on it. Only an Aadhaar QR code or e-Aadhaar PDF whose signature verified is proved.
- Every figure. Stamp duty, registration fees, circle-rate values and the Authority's charges are worked out from rates and rules that change. Check them against the current rates before you quote a client or pay.
- Every deed. A document drawn by the service is a draft for you to read and approve. You are its author.
4. Your clients' papers
You decide what you collect from your clients and why, and you are responsible for having their agreement, and a parent's or guardian's for a minor, to put their papers into the service. We hold and process them on your instructions, as our privacy policy describes, and that policy is part of these terms. You must not put into the service anything you have no right to hold.
5. Your account
Each person signs in as themselves, with a code sent to their own mobile number. The owner of the office decides who has access and must remove anybody who leaves. You are responsible for what is done under your office's sign-ins. Tell us at once if a phone is lost or you think somebody else has access.
6. What you must not do
Use the service to break the law or to help anybody else do so; try to reach another office's records; probe or disrupt the service; resell it; or use it to draw documents you know to be false.
7. Paying
The subscription and credits are charged as set out on the pricing page or as agreed with you in writing, in Indian rupees, with GST added, against a tax invoice. A subscription renews until you cancel it. Credits are spent one for each picture or page read by machine; a read that fails is given back. Refunds and cancellation are covered by the refund policy, which is part of these terms.
8. Keeping it running
We will keep the service available and secure with reasonable care, and tell you in advance of planned interruptions where we can. We do not promise that it will never be interrupted or that it will be free of faults. We may change the service as it develops, and will not take away something you rely on without telling you first.
9. Your records are yours
You own your office's records. You can take a copy at any time, and when you leave, and we will then erase them as the privacy policy describes. We own the software and the Bharatlekh name.
10. How much we are liable for
The service is provided as it is. We are not liable for a loss that comes from a reading, a figure or a document that you did not check, from anything a government office or authority does or refuses to do, or from your not having your clients' agreement. We are not liable for loss of profit or business, or for indirect loss. For anything else, our total liability to you in any twelve months is limited to what you paid us for the service in those twelve months. Nothing in these terms limits liability that the law does not allow to be limited.
11. Ending it
You may cancel at any time, and the service continues to the end of the period you have paid for. We may suspend or end an account that breaks these terms, is not paid for, or puts the service or other offices at risk, and will tell you why. After it ends you have 30 days to take a copy of your records.
12. Changes to these terms
We may change these terms and will tell you at least 15 days before a change that matters takes effect. If you do not accept it you may cancel and be refunded for the unused part of what you have paid.
13. The law
These terms are governed by the laws of India. The courts at Gautam Buddha Nagar, Uttar Pradesh, have jurisdiction over any dispute, after the two of us have first tried in good faith for 30 days to settle it.
